Code Change Summary: Modifications made to integrate Chapter 8 into the overall structure of the code.
SME commentary: In the 2026 NEC®, a change in 90.3 was made regarding Chapter 8 which will also align with the movement to restructure the NEC® over the next two code cycles.
With this change, chapter 8 will no longer stand alone, and is included with Chapters 5, 6, and 7 in that it can supplement or modify the requirements in Chapters 1 through 8 (See modified figure 90.3).
The 2026 NEC® is now organized into an introduction and nine chapters. Chapters 1 through 4 provide general requirements, while Chapters 5 through 8 may supplement or amend the provisions of Chapters 1 through 8.
Historically, Chapter 8 has been exempted from the requirements of Chapters 1 through 7 unless specifically referenced within Chapter 8. This approach was rooted in past practices where communication systems were predominantly installed by utility companies in premises wiring or public utility easements. However, modern premises communications wiring is now installed in the same manner as other premises wiring, mostly by electricians or entities other than utility companies. Maintaining the exemption for Chapter 8 systems, while applying different requirements to other energy-limited systems, creates enforcement challenges and inconsistencies, despite the hazards being identical.

90.3 Code Arrangement. The Code has an introduction and nine chapters, as shown in Figure 90.3. Chapters 1-4 apply generally. Chapters 5-7 apply to special occupancies, special equipment, or other special conditions and may supplement or modify the requirements in Chapters 1-7.
Chapter 8 covers communications systems and is not subject to the requirements of Chapters 1 through 7 except where the requirements are specifically referenced in Chapter 8.
Chapter 9 includes tables that are applicable as referenced.
